Devereux Chambers to lead crowdfunded Brexit legal challenge

Barrister Jolyon Maugham QC is teaming up with human rights firm Bindmands to take on the EU referendum result.

A crowdfunding campaign launched by Mr Maugham has successfully raised £10,000 to underwrite a public law case against the result of the recent EU referendum, in which a narrow majority of Britons voted to withdraw the United Kingdom from the EU. The funding appeal, hosted by online platform CrowdJustice, achieved full financial backing just 12 hours after going live, with 400 individual donors making contributions to the campaign. Mr Maugham will use the funds to pay for advice from Bindmans public and human rights partner John Halford and a team of constitutional law barristers.

Advice to whom?

The case being put together by Mr Maugham and Bindmans will focus specifically on the 'advisory' status of the recent referendum, calling for transparency and accountability around how the referendum result will be interpreted and translated into policy by members of Government. 'If parliament had intended for the result of the referendum to be binding it could have done so. But it did not intend that,' argues Mr Maugham. Some lawyers have interpreted the recent referendum as a threat to the sovereignty of the UK parliament, where the vast majority of MPs are in favour of remaining in the EU. Mr Maugham questions exactly who the referendum result has advised, and thus who should be are responsible for deciding a course of action based on the referendum result. 'This is an incredibly important moment in our nation's history. Everyone -- those who voted both Leave and Remain -- is entitled to be sure of the constitutional basis for removing the UK from then EU,' he said.
