Ex-Cravath Swaine associate loses high-profile Kleiner Perkins case

The public might have been surprised that Ellen Pao lost her case against her former employer, the leading venture capital firm Kleiner Perkins, but employment specialists were not expecting a win for the corporate lawyer.

The case has been one of the main talking points in Silicon Valley during March. Ms Pao brought the case, alleging sex discrimination and retaliation as regards her career development, particularly lack of promotion to a high level, at Kleiner Perkins. Another claim was added by her lawyers - that of retaliation, that she was fired in retaliation to the discrimination suit. Kleiner Perkins said that she lost her job because of performance issues.  

Jury

Many commentators were surprised that Kleiner Perkins did not settle, thus avoiding days of evidence about poor relations at the business. But, even before the verdicts, Wayne Outten of Outten & Golden was holding out little hope for the Harvard Law School-educated Ms Pao. A specialist who has won awards against Morgan Stanley, Deutsche Bank and many others, Mr Outten thought she was not likely to win on the discrimination arguments but might do better on retaliation. That was how the jury voted, rejecting the discrimination claims and also the retaliation one - but, at first, by a smaller majority than is acceptable in California.
