Irish law firms which recruit interns but do not pay them could end up stuck in a legal grey area about their duties.

An analysis by The Irish Times explains how the terms ‘intern’ and ‘internship’ are not defined within Irish law. The crucial issue appears to be whether interns can be deemed to be employees. Whether someone is seen as an employee depends on numerous factors such as the level of control exercised by the organisation over the individual and the concept of mutuality of obligation. The Irish Times analysis concludes: ‘Some employers may try to contract out of this [the relationship being deemed to employment if certain factors exist] and the terms of any agreement or contract can be relevant, but a clause stating that a person is not an employee is not necessarily binding’.
