Lawyers have no obligation to report mental decline to the bar

The Kansas Bar has ruled that there is no duty to report mental decline if no ethics violation has taken place.

Lawyers are not obliged to report a former partner's memory laspes to disciplinary officials unless the problem has resulted in an actual ethics violation, an opinion by the Kansas bar's ethics committee has stated. Instead anyone concerned should look at referring the problem to a lawyer assistance programme, the committee advised. Source: Bloomberg
