Ralph Lauren celebrates victory over polo mark

The fashion company was successful after five years of litigation against FreshSide.

Ralph Lauren has celebrated a victory protecting its famous polo player mark Ken Wolter

Fashion brand Ralph Lauren has been successful in protecting its trademark after a five year battle with FreshSide. The company, known as ‘Chuck', applied to register a trademark with the OHIM, which is responsible for registering trademarks in the European Union. FreshSide's application to use a mark of a polo player on a bicycle caused Ralph Lauren to oppose the application on the grounds that it was too similar to its trademark of a polo player on a horse and would infringe Ralph Lauren’s trademark rights.  After rejection of its case by two courts, the company took the case to the General Court which found for Ralph Lauren, pointing out that shoppers usually see marks in their entirety and could be confused.
