US prosecutors take aim at individuals over financial crisis

The outgoing US Attorney General, Eric Holder, has given prosecutors 90 days in which to start cases against individuals over the 2007/08 global financial crisis - and has stated publicly that the prosecutors are eager to bring such actions.

Mr Holder, who could well be in retirement within 90 days as he is only waiting on the formal appointment of a successor, said: 'To the extent that individuals haven’t been prosecuted, people should understand it’s not for lack of trying. These are the kinds of cases that people come to the Justice Department to make. The inability to make them, at least to this point, has not been a result of a lack of effort.'

Years of investigation

However, a lawyer with experience in the regulatory sector, said that he did not expect that individual prosecutions would happen since the Justice Department had been investigating for several years without a prosecution being forthcoming. On top of that, the threshold for bringing cases against individuals - who are less likely to settle - is higher than for companies. Source: Financial Times
