High Court throws out lawyers' fixed fee challenge

Lawyers attempting to challenge the new fixed costs structure for personal injury claims had their requests rejected by the High Court in London yesterday.

The Association of Personal Injury Lawyers (APIL) and the Motor Accident Solicitors Society (MASS) both challenged the Government reforms which are expected to slash the earnings of law firms handling employers' liability, public liability and motor claims, reports Legal Week.

The Government last week confirmed that from the end of April, the basic road traffic accident (RTA) Portal fee - which covers claims up to £10,000 - will be cut from £1,200 to £500.
The move will impact those negotiating with insurers for compensation with their injuries as victims will not know what their injuries are worth and will be at the mercy of insurers.
However, the government says that, amongst other benefits, it will reduce legal costs and give consumers savings on insurance premiums.
