Lawyer Ross Day says he has no obligation to fulfill a $140,000 settlement agreement with Andrea Meyer, a fellow lawyer and former colleague at his Oregon law firm, because Ms Meyer has violated the agreement's terms. He is also demanding that Ms Meyer return the first $2,500 installment of the settlement that has already been paid. Mr Day quietly agreed to the settlement last year after Ms Meyer filed a lawsuit in 2014 alleging that Mr Day harassed her in their workplace by attempting to engage her in conversations about the erotic novel 'Fifty Shades of Grey' and sending her sexually explicit emails using a fake name. Mr Day denied any wrongdoing at the time of the settlement, which was originally to be paid in installments over a 10 year period. He has since filed for bankruptcy.
Violations
The lawsuit filed by Mr Day on 12 February alleges that Ms Meyer twice violated the non-disclosure agreement attached to the settlement. Firstly, it alleges that Ms Meyer brought a third-party companion to a creditor's meeting in Mr Day's bankruptcy case who had no legal right to know about the settlement or its terms, and that she spoke about the settlement before the meeting. Secondly, Ms Meyer filed an action against Mr Day in U.S bankruptcy court stating that Mr Day's debt to her is not dischargeable in bankruptcy, which Mr Day's lawsuit argues 'goes to great lengths to restate and relitigate the facts and issues.'
