England and Wales divorces still among the world's most generous

Research shows that courts in England and Wales are the fifth most generous in the world when it comes to awarding ongoing maintenance for financially dependent ex-spouses.

A new report from Penningtons Manches has analysed current legislation and case law across 16 jurisdictions to conclude that couples uncoupling in England and Wales enjoy the fifth most generous ongoing maintenance awards. However, the report also highlights a gradual trend towards expecting ex-spouses to become more quickly self-sufficient after divorcing.

'Gone are the days in England and Wales when the weaker financial party could expect lifelong financial support without examination of their earning potential or the lifestyle adjustments they could make to become self sufficient,' commented Penningtons Manches partner James Stewart, a co-author if the report.

England and Wales ranked fifth behind India, California, Singapore and Ireland, which took out the top four positions on the Penningtons Manches ranking. At the other end of the list were the United Arab Emirates, Finland, Japan and Russia, where there is little or no ongoing maintenance on offer for financially dependent couples looking to divorce.
