Litigation is on the up, with one in three corporates reporting an increased number of legal disputes - leading to a higher legal spend on litigation over the past 12 months.

Contract and intellectual property disputes were the most common types of action. Meanwhile, respondents  said their companies were more likely to settle litigation than go to court. They were also more likely to retain outside counsel for M&A and regulatory investigations than for other legal actions, the report found.

Reducing litigation risk

The Litigation & Corporate Compliance Survey was carried out by Alix Partners and included responses from more than 100 general counsel at companies with annual revenues of $250 million or more, mainly in the US. One in ten said their company was involved in a “Bet-the-Company” lawsuit over the past 12 months and more than a quarter (27 per cent) said their litigation department had increased in size over the past year.  Early case assessment is important, according to 68 per cent of respondents with most saying they were reducing risk by reassessing compliance programmes and implementing new tools.
