A fresh spin on that thought-provoking proposition comes from Somerset in England, where a judge has ruled that urinating in public is not a nuisance, provided no-one sees the actual micturation occurring.
In handing down that profound bit of jurisprudence, the judge has disappointed a married couple who had brought an action against the local authorities for allowing a lay-by near their home to be used as an ad-hoc lavatory by passing motorists.
According to The Daily Telegraph newspaper, the lawyer for the county council argued that the couple had no legal cause for complaint, as to view the actual relieving of bodily functions they would have to walk to the end of their long drive ‘to see what was happening’, and as such it did not amount to a nuisance.
The husband and wife claimants will now be landed with a large bill for legal costs, according to the newspaper.
