Brazil prepares for tougher anti-trust regime

2013 is being seen as the year in which Cade, Brazil's competition authority, seriously began flexing its muscles and showed the way it will operate in future.

An order to the company Telefonica this month to reduce its power in the communications sector is being seen as a sign that the basis of a new regime is being created. Gesner Oliveira, formerly  head of Cade and now a consultant in the Go Associados consultancy, says: 'Cade has been progressing over time and the law was a reflection of that.  It took some time for the government to understand the importance of having a modern competition law and there had been a certain resistance on the part of the private sector to submit mergers and acquisition to Cade.'

But now, lawyers are said to be more aware that they will find it difficult to appeal Cade decisions - especially now that Cade has developed a closer relations with the Brazilian justice system. Source: Financial Times
