The ACC has filed an amicus letter with a district court in the US to this effect. It wants the court to overturn a magistrate court's decision in the case of Anwar v Fairfield Greenwhich (a case arising from the Bernard Madoff ponzi scheme). The magistrate held that no privilege covered advice given by a Dutch in-house lawyer to his in-house client and colleague.
Rendered ineffective
'Confidential legal advice should not be subject to the whim of a plaintiff’s forum selection,' says Veta T. Richardson, president and CEO of ACC. 'Without a guarantee of attorney-client privilege, lawyers who work for multinational companies will be rendered ineffective, hurting legal processes and access to justice. This issue is especially important to in-house lawyers, whose employers’ operations increasingly span national boundaries.'
