Chinese GC fears arrest in US federal investigation

Clifford Chance has asked a judge to show 'mercy' to the GC of one of its clients. The judge ordered the GC to come to the US, despite fears he will be arrested in an investigation into a violation of the embargo against the Iranian regime.

Southern District of New York judge Lewis Kaplan has ordered Guo Xiaoming of the ZTE Corporation in China to appear in court in a long-running patent dispute with Vringo Inc., a week after ZTE revealed he fears being arrested in connection with a federal criminal investigation into the telecommunications technology maker's alleged sale of banned technology to Iran.

Deposed outside the U.S.  

Judge Kaplan said ZTE was attempting to seek the court’s aid to avoid providing federal law enforcement with information and possibly to avoid answering charges of violation of U.S. law, while simultaneously wanting the benefit from Mr Guo’s testimony to pursue its lawsuit against Vringo and defend against Vringo's own suit over a nondisclosure agreement.
