The National Law Journal reports that Victoria Anderson’s case was thrown out by the Court of Appeals for the Fourth Circuit after it was found that Ms Anderson did not suffer impairment under the Americans with Disabilities Act and was not fired because of it.
Legitimate reasons
In upholding the ruling of a lower court, the appeal panel said the company had every right to fire Ms Anderson – who worked as a lawyer for the programme, production and talent division of Discovery Communications – for the legitimate reasons they had listed, including her failure to keep proper time sheets and an inability to communicate accurately and truthfully with co-workers.
Ms Anderson - now an associate at Gray Krauss Stratford Des Rochers in New York – declined to comment, as did her lawyer Elaine Fitch of Kalijarvi Chuzi Newman & Fitch in Washington.
Discovery’s legal representative, Amanda Haverstick - special counsel at Proskauer Rose did not respond to requests for comment.
