Vivien Shevitz is representing two well-known businessmen, Alberto Vilar and Gary Tanaka, who were given prison sentences in 2008 for stealing from clients when they were partners in Amerindo Investment Advisors. Now both out of jail, they are engaged in a hearing which will reset the sentences they were given. However, Ms Shevitz is now romantically linked to Mr Tanaka. Lawyers at the Justice Department have written to the sentencing judge, District Judge Richard Sullivan in Manhattan, saying that the liaison 'by all appearances, would impair Ms. Shevitz’s duty of loyalty to Vilar and cloud her judgment with respect to Tanaka'. The lawyers have sent a list of questions to put to the two men to ensure that they understand the potential conflict of interest and that they are willing to accept it, according to Bloomberg Businessweek.
