Lawyers outline Scots independence route to EU

Three expert lawyers have suggested ways for an independent Scotland to join the EU as a new state, after a period interim arrangements - a scenario they view as most likely if Scotland leaves the UK.

Measures proposed by the current Scottish leadership to keep Scotland within the EU are not seen as viable by the trio. They are described as 'legally implausible and incredibly politically risky', by Professor Kenneth Armstrong of Cambridge. Aiden O'Neill QC, a constitutional expert, agreed that a new application would have to be made for Scotland to join the EU. He said that interim arrangements would need to be made, however. He said: 'Something will be worked out, it always is. If one were to posit the possible nightmare scenario of Scotland being independent outside the EU with British nationality no longer afforded to Scottish citizens, then EU nationals here are no longer within the EU and no longer have claims against an independent Scotland for their EU rights.  But more stunningly is that Scottish nationals working elsewhere in the EU, presumably also including London, would lose all their EU rights.'
