The case is being heard in the Royal Courts of Justice in London, with Mr Mitchell claiming that collusion between RBS, Torex financial advisers KPMG and New York-based firm Cerberus Capital Management led to the purchase of the company at around £400m below its value, which caused its collapse. He is bringing a separate action in the US against Cerberus Capital Management.
