More class actions likely for data breaches

A recent ruling by London's Court of Appeal could open the floodgates for compensation over data breaches.

Compensation is now payable without the need to show financial loss in the event of data breaches, a UK law firm has warned.The recent ruling by the Court of Appeal in Google Inv v Vidal-Hall Court clarified the rules under Clause 13 of the Data Protection Act 1988 which only allowed compensation claims for date breaches if they caused financial loss.  

Class actions 

John Warchus, partner at Moore Blatch, warned companies to review their data policies as he predicted more class actions and increased damages were likely. 'Anyone in control of data, will now have an even stronger incentive to comply with data protection rules. The decision by the Court of Appeal is also consistent with the likely future trend of data protection legislation – the draft EU Data Protection Regulation will mean that someone can seek damages regardless of a financial loss,' he said.
