The Global Legal Post today launches the 2026 Law Over Borders Commercial Litigation guide.
Edited by London-based McDermott Will & Schulte partner Hilton Mervis, the guide provides a practical and up-to-date overview of litigation, arbitration and alternative dispute resolution across nearly 40 international jurisdictions.
Written by leading lawyers in their respective markets, it examines the core features of civil justice systems, procedural frameworks, enforcement regimes and the role of arbitration within the broader dispute resolution landscape.

A unique feature of the guide, which has 58 chapters covering 39 jurisdictions, is a case study that invites the authors to provide their opinion on how a novel contractual arbitration clause designed by Mervis to facilitate the enforcement of cross‑border monetary court judgments would be treated in their respective countries.
Mervis said: "The model answer to the case study considers the operation of the clause I have developed. It is not an attempt to convert a court judgment into an arbitral award. It creates an independent contractual entitlement to an amount equivalent to the judgment debt determined by the chosen court, together with interest and costs, with a separate and irrevocable arbitration clause triggered by non-payment of that contractual obligation. That, in turn, is intended to open up a route to enforcement of the outstanding amount under the New York Convention, which currently has 172 parties."
The clause is one of an array of topics to be debated at the roundtable Commercial Courts in a Connected World: Judicial Dialogue and Private Law Innovation in Cross-Border Litigation, which takes place on 3 June from 2-3:30pm.
