As part of the American Society of International Law’s ‘Studies in International Legal Theory’ series – initiated in 2009 to clarify and improve the theoretical foundations of international law – this book explores the role that ethics play in public and private international law.
Each year, the society aims to improve awareness on a specific part of international law, discussing its principles, goals, development and implementation.
Donald Earl Childress, associate professor of law at California’s Pepperdine University and vice-chairman of ASIL’s international theory interest group – has collected the views of leading professors to define the ways in which ethics can affect public and private international law through creating, sustaining or changing legislation.
The book also seeks to build on the similarities that can be drawn between public and private international law, subjects which are often viewed as two different entities.
This volume also explores the varied options for cross-disciplinary exchange in vital fields, while showing that engaging the ethical dimensions of international law doesn’t necessarily mean using ethics as raw politics
or power.
