LA law firm Munger, Tolles & Olson trumped by Harvard Law lecturer

When Munger Tolles & Olson's decision to require its student summer associates to sign forced employment arbitration clauses was leaked, they did not expect a social media backlash.

Being the age of Trump, the LA-based litigation firm Munger, Tolles & Olson took to Twitter to issue a mea culpa to its 315 followers: 'Munger, Tolles & Olson is committed to the highest standards of conduct. In this case, we were wrong, and we are fixing it. We will no longer require any employees, including summer associates, to sign any mandatory arbitration agreements.'

An unusual agreement

A student appears to have leaked the decision, leading Harvard Law School lecturer Ian Samuel, who has 12.7k followers, to tweet a sequence of pictures of the firm’s arbitration agreement, stating 'Wow. A major biglaw firm, Munger Tolles, is requiring summer associates to sign a very unusual agreement. Details on this thread but (1) it’s super gross, (2) I’ve never seen this before, and (3) it is plainly calculated to shield them from claims of harassment. Let’s begin!'

Power imbalance

Mr Samuel claimed the policy was one 'plainly calculated' to shield the law firm from sexual harassment and race discrimination claims. He tweeted: 'I think this is the grossest thing I’ve ever heard. Munger ought to be ashamed of themselves. And I will be making an extremely large fuss about this. Talk to y’all soon.'
