The Global Legal Post today launches the inaugural edition of the Law Over Borders Enforcement of Judgments guide.
Edited by Andrew Bartlett, head of Osborne Clarke’s international enforcement practice, the guide provides a comparative overview of the enforcement of judgments and arbitration awards across multiple jurisdictions.
Written by leading lawyers in their respective markets, the guide examines the legal frameworks for recognition and execution, key requirements and defences and the procedural steps involved.
Bartlett writes in the introduction: “A court judgment that cannot be enforced is likely to be a pyrrhic victory, so the importance of enforcement cannot be overstated.
“Cross-border enforcement is a particularly complicated area of legal practice, requiring practitioners to navigate different legal systems, national laws and a range of international agreements and conventions. Successful strategies require the combination of experience-based pragmatism with an in-depth understanding of the legal principles.”
Chapters are arranged in a Q&A format, making it easy for readers to compare how different jurisdictions address the same issues. The online version allows users to select questions across jurisdictions to further facilitate comparative analysis.
The authors emphasise the need for devising an early strategy for enforcement, which includes asset identification and preservation. Interim measures, appeals and enforcement against complex asset structures, including third-party holdings, also come under the microscope.
There are also a series of thematic market insight chapters covering key developments in the enforcement of judgments arena.

The print version of the guide will be launched during an official London International Disputes Week event at Ashurst’s London offices, chaired by Bartlett.
