Citing concerns about the ‘progress and direction’ of the inquiry, barrister Toby Fisher first flagged his desire to resign from the IICSA in August this year. Mr Fisher’s decision to leave came shortly after the exit of the inquiry’s third chair Dame Lowell Goddard and in the aftermath of reports of alleged sexual assault on the part of Counsel to the Inquiry Ben Emmerson QC, who has also since resigned. Mr Emmerson’s deputy counsel Elizabeth Prochaska also submitted her resignation last month, but denied that her decision to resign was influenced by the controversy surrounding her colleague. As first junior counsel, Mr Fisher was the equal second-most senior barrister on the inquiry and was one of the first three barristers ever appointed to the IICSA. Both Mr Fisher and the IICSA have declined to comment on his resignation.
