BCE is arguing that the government cannot force it to continue to share its network over cell towers with new entrants after this year. Earlier this year the government decided to extend the network-sharing rules beyond a few year period which ends in 2013.
Developing network infrastructure
According to Reuters, BCE says in its submission: 'Companies cannot be expected to bid hundreds of millions of dollars for the right to acquire and use spectrum, and many more hundreds of millions of dollars to develop network infrastructure, if the conditions of its use can be subject to arbitrary, unilateral change during the term of the licence.' Blake, Cassels & Graydon is representing BCE in the case, being take in the name of its subsidiary Bell Mobility. The case is called Bell Mobility v Attorney General of Canada (file number T-1474-13).
