GCs face risks if they neglect e-discovery

GCs could be in 'real trouble' if they leave all the e-discovery expertise to outsiders and do not have some familiarity with the systems themselves.

This is one of the warnings made at the Ontario Bar Association's e-discovery institute this autumn. Susan Nickle, now GC at the London Health Sciences Centre and formerly of Wortzman Nickle PC, said that it is not sufficient to delegate everything to outsiders. 'You could be in real trouble,' she warned, suggesting that delays before appointing external advisers, missing documents and the need to understand the IT could all create problems for unwitting inhouse counsel.
