Cadwalader cleared of malpractice in Nomura case

The New York Court of Appeals has found that Cadwalader, Wickersham & Taft gave 'proper advice' on a Nomura Asset Capital mortgage-backed securitisation, finding in favour of the firm and ending a long-running dispute.

Nomura sued Cadwalader in 2006, after a loan underlying one particular commercial securitisation went bad and Nomura ended by paying out US$67.5m by way of a settlement. 

Due dligence

As well as finding that the law firm gave proper advice, the Appeals Court held that it had 'conducted the due diligence required in the context of its representation of Nomura'. Source: Bloomberg Business of Law
