The dispute follows Britain’s move to change the law of succession in 16 Commonwealth countries - passed by all countries including Canada. However, two constitutional law professors at Quebec’s Laval University have launched a case in the city’s Superior Court just a month before the birth of Prince William’s first child, due in July.
Unconstitutional
The case alleges that the Canadian government acted unconstitutionally by failing to seek the approval of each of the country’s 10 provinces before agreeing to the succession changes, according to the Business Standard. The two professors also claim there is a breach of Canada’s Charter of Rights and Freedoms as the new succession laws still stop a Catholic or other non-Anglican from becoming monarch. The case could take between six months and five years.
