Cyprus bar to face price-fixing challenge over EU rules

The challenge over the fees basis used for non-court cases is being brought by the London-based Fairness in Fees group and will be made by Robert O'Donoghue of Brick Court Chambers.

The case over the Cyprus Bar Association's 'minimum fee regulations' is to take the form of a complaint to the European Competition Commission. George Lambis, founder of the group, said that the situation in Cyprus was believed to be 'unique within the EU', adding: 'The minimum fee regulations set out formulae for calculating lawyers’ fees irrespective of the time spent or the complexity of the matter.'

Breach of EU Treaty

Under the Bar Association rules, the execution of a will could cost 10 times more in Cyprus than in the UK, says the group. The complaint will say that the rules are a clear breach of the cartel and price-fixing provisions of Article 101 of the Treaty of Rome. Source: Cyprus Property News
