The debtors applied to have Kirkland & Ellis acting for them earlier this year, and this application was approved by the court in May. But the noteholder committee says that it has allegedly 'recently discovered that testimony offered by Kirkland in support of that application was incomplete and misleading'.
Disqualified
The noteholders go on to state: 'Kirkland should be disqualified from any other form of involvement with the estates’ claims against [the parent] and its affiliates, including any investigation or settlement thereof.' Source: Bloomberg Business of Law
