Voyager lawyer loses appeal

The Australian lawyer who was accused of double-billing survivors of the HMAS Voyager disaster has lost an appeal to retain his practising certificate after evidence revealed he made 'threatening' comments to a member of the Legal Services Board.

The Court of Appeal upheld a Victorian Civil and Administrative Tribunal (VCAT) decision in judging David Forster unfit to practise as a lawyer, reports Lawyers Weekly.
In the appeal court decision, Justice Emilios Kyrou referred to evidence that during a VCAT hearing in 2010 Mr Forster repeatedly called senior counsel Kristine Hanscombe a ‘monster’ when he was ‘within inches of her face’.

Lawyer ban

Ms Hanscombe, in her position as a senior counsel at the Legal Services Board, had been arguing to have Mr Forster banned from legal practice and his firm, Hollows Lawyers, placed in receivership.
Mr Forster did not deny he had repeatedly called Ms Hanscombe a monster, but he disputed that he had done so within inches of her face. He later apologised for his language and stated that he was under great stress at the time.
